OVERVIEW

Welcome to EveryCorner. The terms “we”, “us”, and “our” refer to EveryCorner, operated by NAV ORGANIC FOODS PRIVATE LIMITED (“Company”). These Terms of Service (“Terms”) govern your access to and use of our website, products, tools, features, and services (collectively, the “Services”).

Our store is powered by Shopify, which allows us to sell products and operate this website.

By accessing or using the Services, you agree to these Terms and our Privacy Policy and Return, Replacement & Exchange Policy. If you do not agree, please do not use the Services.

1. ACCESS & ACCOUNT

1.1 Eligibility. To use our Services, you must be at least 18 years old (age of majority under Indian law).
1.2 Accurate information. You may be required to provide accurate and complete information, including your email, payment details, and shipping address.
1.3 Account security. You are responsible for maintaining the confidentiality of your account credentials and all activity under your account. You must notify us immediately if you suspect unauthorized access or use.

2. OUR PRODUCTS

We make reasonable efforts to display our products accurately. However:

  • Colours and appearance may vary based on your device/screen settings.

  • Product descriptions, specifications, packaging, and prices may change without notice.

  • We may limit quantities, restrict sales, or discontinue items at any time.

  • Unless explicitly stated, we do not guarantee that a product will meet every individual expectation or use case.

3. ORDERS

3.1 Offer to purchase. By placing an order, you make an offer to purchase a product.
3.2 Order acceptance. Orders are accepted only when we confirm acceptance and process payment (or otherwise confirm the order as accepted).
3.3 Right to cancel/limit. We may decline, modify, or cancel any order at our discretion (including suspected fraud, pricing errors, stock limitations, or verification issues). If we do so, we will attempt to notify you using the contact details provided at checkout and refund eligible amounts if charged.
3.4 Policy governs post-purchase. Your purchases are governed by our Return, Replacement & Exchange Policy (7-day window; mandatory video proof; no returns for damaged products; subject to verification and inspection).
3.5 Personal use only. Purchases are intended for personal use. Unauthorized resale, redistribution, or export is not permitted without written consent.

4. PRICES & BILLING

4.1 Currency. All prices are displayed in Indian Rupees (₹) and may change without notice.
4.2 Taxes and shipping. Unless specified otherwise, prices may include applicable taxes but may exclude shipping/handling charges which are shown at checkout or in the shipping policy.
4.3 Promotions. Promotions may have separate terms that override these Terms for the promotional period.
4.4 Payment authorization. You agree to provide accurate payment information and authorize us to charge your selected payment method for the order total, including applicable taxes and shipping charges.

5. SHIPPING & DELIVERY

5.1 Service area. We ship across India. International shipping is currently not available unless explicitly stated on the store.
5.2 Estimated timelines. Delivery timelines are estimates only. We are not responsible for delays caused by carriers, natural disasters, government actions, or factors beyond our control.
5.3 Risk of loss. Once an order is handed over to the carrier, the risk of loss transfers to you, subject to applicable consumer protection laws.
5.4 Delivery inspection. You should inspect packages upon delivery. If the outer packaging appears damaged or tampered, you should record video evidence and report it promptly to the carrier and to us via admin@everycorner.in.

6. INTELLECTUAL PROPERTY

All content on the Services—including text, images, logos, graphics, and product designs—is owned by the Company, EveryCorner, or its licensors and protected by applicable intellectual property laws, including the Indian Copyright Act, 1957 and the Trade Marks Act, 1999.

You may use the Services only for personal, non-commercial purposes. No content may be reproduced, modified, distributed, or republished without prior written permission.

7. OPTIONAL THIRD-PARTY TOOLS

We may offer access to third-party tools, payment gateways, or integrations that we do not monitor or control (e.g., payment processors, logistics partners). Such tools are provided “as is” and “as available” without warranties. Your use of third-party tools is at your own risk and subject to their terms.

8. THIRD-PARTY LINKS

Our Services may contain links to third-party websites. We are not responsible for their content, accuracy, privacy practices, or policies, and accessing them is at your own risk.

9. RELATIONSHIP WITH SHOPIFY

EveryCorner is powered by Shopify, but sales are made directly between you and the Company. Shopify is not a party to these Terms and is not responsible for orders, products, damages, or claims arising from your use of the Services.

10. PRIVACY & DATA PROTECTION

All personal information is governed by our Privacy Policy and, where applicable, Shopify’s privacy practices. We comply with applicable Indian laws, including the Information Technology Act, 2000 and the Consumer Protection (E-Commerce) Rules, 2020. By using the Services, you consent to the collection and processing of your information as described in those policies.

11. FEEDBACK

By submitting feedback, ideas, reviews, or suggestions (“Feedback”), you grant us a worldwide, perpetual, royalty-free license to use, modify, publish, or distribute such Feedback for any purpose without compensation, subject to applicable law. You represent that your Feedback does not infringe third-party rights.

12. ERRORS & INACCURACIES

We strive for accuracy, but errors may occur in product descriptions, pricing, availability, or promotions. We reserve the right to correct errors and to cancel orders placed at incorrect prices. If your order is cancelled due to a pricing error, we will notify you and process a refund for any amount charged for that order.

13. PROHIBITED USES

You agree not to misuse the Services, including but not limited to:

  • Violating laws, regulations, or these Terms

  • Uploading malware or malicious code

  • Harassing, threatening, or harming others

  • Impersonating any person or entity

  • Scraping/crawling/automated data collection without permission

  • Attempting unauthorized access or interfering with security features

  • Fraudulent, illegal, or unauthorized use

  • Manipulating prices, reviews, or ratings

We may suspend, restrict, or terminate access for violations.

14. TERMINATION

We may terminate or suspend your access to the Services at any time, with or without notice, for any reason including breach of these Terms. Upon termination, your right to use the Services ceases immediately. Provisions relating to intellectual property, disclaimers, limitation of liability, indemnification, and governing law survive termination.

15. DISCLAIMER OF WARRANTIES

Unless expressly stated, the Services and products are provided “as is” and “as available” without warranties of any kind, whether express or implied. We do not warrant that the Services will be uninterrupted, secure, error-free, or virus-free, or that any defects will be corrected, to the extent permitted by law.

16. LIMITATION OF LIABILITY

To the fullest extent permitted by Indian law, the Company and its directors, employees, affiliates, and partners shall not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or goodwill.

Our total aggregate liability for any claim shall not exceed the amount you paid for the specific product or service giving rise to the claim.

Some jurisdictions do not allow certain limitations; where required by law, these limitations may not apply.

17. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless the Company, EveryCorner, Shopify, and their affiliates, directors, officers, employees, and agents from claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:

  • Your use or misuse of the Services

  • Your breach of these Terms

  • Your violation of any law or regulation

  • Your violation of any third-party rights

  • Any content you submit through the Services

18. CONSUMER RIGHTS UNDER INDIAN LAW

Nothing in these Terms limits your rights as a consumer under applicable Indian laws, including the Consumer Protection Act, 2019. In case of conflict, applicable law prevails.

19. DISPUTE RESOLUTION

19.1 Informal resolution. Before filing any formal claim, you agree to contact us at admin@everycorner.in to attempt informal resolution.
19.2 Arbitration. Any disputes not resolved informally shall be settled by arbitration in accordance with the Arbitration and Conciliation Act, 1996. The arbitration shall be conducted in English.
19.3 Seat / venue. The seat and venue of arbitration shall be Lucknow, Uttar Pradesh, India.
19.4 Court jurisdiction. For matters not subject to arbitration or for interim relief, courts in Lucknow, Uttar Pradesh, India shall have jurisdiction, subject to applicable law.

20. SEVERABILITY

If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect.

21. WAIVER & ENTIRE AGREEMENT

Failure to enforce any right is not a waiver. These Terms, together with the Privacy Policy and Return, Replacement & Exchange Policy, constitute the entire agreement between you and us regarding the Services.

22. ASSIGNMENT

You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations at any time.

23. GOVERNING LAW

These Terms shall be governed by the laws of India, without regard to conflict of law principles.

24. UPDATES TO TERMS

We may update these Terms from time to time. Material changes will be notified via email or a prominent notice on our website, where required. Continued use after changes become effective constitutes acceptance of the revised Terms.

25. FORCE MAJEURE

We shall not be liable for failure or delay due to events beyond reasonable control, including natural disasters, epidemics/pandemics, war, civil unrest, government actions, telecom/internet failures, labor disputes, supply chain disruptions, and carrier delays.
